Independent Tutor Terms of Contract


Please read the following before filling out our online application.  In order to tutor for us, you must agree to these terms.  

I understand that this contract is with Renaissance Enrichment Services, LLC (Also known in this contract as RES).  I am contracting with Renaissance Enrichment Services, LLC as an independent contractor, and will receive a 1099 Federal Income Tax Form at the end of the tax year.  I understand that I am responsible for paying my own Federal and State income taxes, to be filed on a Schedule "C" form at the end of the tax year for any income derived from Renaissance Enrichment Services, LLC.

The following items must be on file with Renaissance Enrichment Services, LLC before any tutoring may commence:

  • Completion of online application
  • Tutor's resume
  • Signed contract
  • Copy of BCI report and FBI Background check (Unless provided to RES by the LEA)
  • A copy of the Tutor Info Sheet
  • Conflict of Interest approved by CMSD, if applicable.
  • Contract Attachment A; RES recruiting policy
  • The tutor named on this contract agrees to provide the following services:

    1. It is hereby agreed that the tutor's relationship with Renaissance Enrichment Services, LLC shall be that of an independent contractor and not that of an agent, partner, or joint venture.


    2. Provide supplemental educational services according to the terms described in No Child Left Behind.


    3. All supplemental educational services provided pursuant to this contract will be of high quality, and research-based.


    4. The tutor agrees to provide RES, the LEA, State, or Federal governments with any information requested, so that the above mentioned entities may fulfill their responsibilities to monitor the quality and effectiveness of the services provided.


    5. Comply with all Federal, State, and local school boards, health, safety, and civil rights laws, regulations, and policies.


    6. Services to special populations:


    7. A. Tutor agrees to provide appropriate supplemental educational services and accommodations in the provisions of those services to students with disabilities under the Individuals with Disabilities Act, 20 U.S.C. & 1400et. Seq. (IDEA) and students covered under section 504 of the Rehabilitation Act of 1973.  If the students has a disability or disabilities as defined under IDEA, or is covered under Section 504, a description of how tutor will provide supplemental services to the student consistent with the student's individualized education plan "IEP", under 614(d) of IDEA or his/her individualized services under Section 504.
      B.Tutor agrees to provide students with limited English proficiency appropriate supplemental educational services and language assistance in the provision of those services if appropriate.
    8. Renaissance Enrichment Services, LLC agrees to pay tutor for services at a rate up to $15 per hour, per qualified student, with the limit of students per session not to exceed six.


    9. The independent contractor/tutor may request an individual student to appear on their roster. If a particular student is requested by two tutors, Renaissance Enrichment Services, LLC personnel will determine on which roster that student will be placed.


    10. Tutor will not begin to tutor any student for RES until they have been instructed by the RES office, that the child's IAP has been approved by the LEA.  No funds will be paid for hours tutored not in accordance with the aforementioned restrictions.


    11. Tutor will not tutor individual students more than 1 hour for K-3rd and 2 hours 4th-10th daily. Tutor will not tutor individual students more than 4 hours per week, K-3rd and 6 hours 4th-10th. No funds will be paid for hours tutored not in accordance with the aforementioned restrictions.


    12. Tutor will not be paid for hours reported as unapproved to the district absence report.  If tutor is able to amend report through the school office, they may resubmit those hour(s).


    13. Tutors are not permitted to tutor children on days of staff meetings.  This is a district rule, and hours will not be approved.


    14. There will be two pay periods: A.  1st period, October 1, 2010 through January 31, 2011 -- Checks will be distributed April 15, 2011. B.  2nd period, February 1, 2011 through April 15, 2011 -- Checks will be mailed to addresses on file on July 16, 2010.


    15. All independent contractor/tutors who are connected with Renaissance Enrichment Services, LLC will be required by law to notify Renaissance Enrichment Services, LLC if during the course of this contract, the independent contractor/tutor is convicted in any jurisdiction of any of the following offenses: murder, battery, aggravated battery, kidnapping, criminal confinement, a sex offense under IC 35-42-4, car jacking, arson, incest, neglect of a dependent, child selling, contributing to the delinquency of a minor, abuse of controlled substances under IC 35-48-4, an offense relating to material or a performance that is harmful to minors or obscene under IC 35-49-3, any offense relating to operating a motor vehicle while intoxicated under IC 9-30-5, and offense that is substantially equivalent in any of the offenses listed in the jurisdiction, or an attempt to commit one of the foregoing crimes.


    16. Independent contractor/tutor hereby agrees to protect, indemnify, and save harmless Renaissance Enrichment Services, LLC and its members, officers, agents, and employees from every liability, claim, demand, right of action, loss, cost, damage, or expense, (including attorney's fees), on account of every injury, death, or damage arising out of any act or omission on the part of independent contractor/tutor in the performance of this agreement.


    17. This contract may be terminated by Renaissance Enrichment Services, LLC if independent contractor/tutor fails to comply with any of the above.  Either party may upon ten (10) days written notice to the other, terminate this agreement upon the material failure of the other party to perform its obligations under this agreement, including the codicil hereto, and such failure is no the fault of the terminating party.  Otherwise, this agreement may be terminated by mutual agreement between the parties.  In the event of termination or modification before all the agreed upon services have been provided, payments to Renaissance Enrichment Services, LLC will be provided and made only for services provided.


    18. At no time should independent contractor/tutor contact the TITLE I office.  If you should have a concern you must contact the governing board of Renaissance Enrichment Services, LLC.  If you should contact the TITLE I office either at the district, state, or national level you will be dismissed from your contract.


    19. Tutor may provide information to parents about the Supplemental Services available to their children, but shall not recruit during the school day, or on school grounds.  Any and all recruiting will be done after the school day and off school property.


    20. Independent contractor/tutor agrees to be bound by the terms of the Affirmative Action Laws of the state in which you are tutoring.


    21. This contract constitutes the entire agreement between the parties, and modifications shall not be effective unless same is in writing, and signed by parties.


    22. At no time during the 2010-2011 school year may the independent contractor/tutor work as an independent contractor or hired tutor with any other Supplemental Service Provider.  This does not include Cleveland Scholarship or any District tutoring programs.


    23. Tutor will maintain an organized, complete, and up to date tutor binder to include accurate copies of:
    24. A.  Student Info Sheet -- Print one copy per student your are tutoring. C.  Copy of Signed IAP B.  Monthly teacher questionnaire C.  Copy of signed IAP D.  Copy of Achieve Pre-test Report E.  Weekly rosters (where fingerscan technology is not used) F.  Attendance Recap (where fingerscan technology is not used) G.  Monthly progress report H.  Tutor time sheet

    25. All required paperwork, including but not limited to attendance records and tutor time sheets, will be submitted to the site coordinator by the 5th day of the month proceeding the invoiced month. Failure to provide these documents accurately, and on a timely basis may result in delayed or non-payment.


    26. Final pay check for the '10-'11 school year will not be issued until completion and delivery of tutor binder to the RES office, in Bay Village, Ohio.


    27. Tutor will set up and maintain an email account that accepts emails from respecteducation.com.  The email account must be checked daily as it is the primary mode of communication by Renaissance Enrichment Services, LLC.  If contractor/tutor does not have an email account, one can be provided to them through respecteducation.com.


    28. At no time can students be left unsupervised.  A procedure should be in place for tutor absences.


    29. Independent contractor/tutor agrees to refrain from establishing a supplemental educational services company that is in direct competition with Renaissance Enrichment Services, LLC. Independent contractor/tutor agrees to refrain from establishing any such venture for the period of two (2) calendar years after tutor's termination from Renaissance Enrichment Services, LLC.
